WILL AND PROBATE MARY STERRY, PRAHRAN, VICTORIA, 1907

Will of Mary Sterry, late of Alford St Prahran in the State of Victoria, widow
This is the last Will and Testament of Mary Sterry of 58 Alford Street Prahran in the State of Victoria Widow
I give and bequeath to my nephew Joseph Sterry at the expressed wish of my late daughter Annie Constance Sterry a legacy of twenty five founds. And as to all the rest of my property both real and personal whatsoever and wheresoever situate I give devise and bequeath the same to my son William Eli Sterry absolutely. And I appoint the said William Eli Sterry sole executor of this my will. And hereby revoking all former wills made by me I declare this to be my last will. As witness my hand this twenty fourth day of September 1907.
Signed and acknowledged by the said Mary Sterry as and for her last will in the presence of us present at the same time who at her request and in her presence and in the presence of each other (all three being present at the same time) have hereunto subscribed our names as witnesses. Affidavit
I William Ely Sterry of 58 Alford Street Prahran in the State of Victoria Accountant make oath and say
1. That I am seeking to obtain Probate of the Will of the above named Mary Sterry and I am of the full age of twenty-one years
2. The said deceased died on the twenty eighth day of September 1907
3. The said deceased was unmarried and a widow at the time of her death
4. The said deceased left a Will bearing date the twenty fourth day of September 1907 which is as believe the last Will and Testament of the said deceased and which is unrevoked
5. That the testator was of the full age of twenty-one years at the date of the execution of the said Will
6. By her said Will the said testatrix appointed me this deponent executor thereof
7. The paper hereunto annexed marked “A” is the true last Will and Testament of the said deceased as I verily believe
8. The said Will was executed in the presence of Alfred Herbert Wilmoth of Dandenong Road Murrumbeena and 82 Elizabeth St Melbourne Solicitor and Frederick Elmore Watts of “Sidfred” Empress Rd East St Kilda Law Clerk.
9. The said deceased left real estate in the State of Victoria not exceeding the value of six hundred and seventy five pounds and personal property in the said State not exceeding the value of six hundred and ninety pounds one shilling and six pence.
10. That if I obtain probate I will well and truly collect and administer according to law … the property lands and hereditaments goods chattels and credits of the said deceased … I will make or cause to be made a true and perfect inventory of all and singular the property, lands etc … and will exhibit and deposit or cause to be exhibited the deposited the same inventory in the Master of Equity within three calendar months … I will make … a true and just account of the administration of the estate
11. That I am the William Eli Sterry named in the said Will
